Advertiser Agreement
Welcome to Empire Yachting. By using any of our platforms or affiliated domains (the “Website”), you agree to comply with the terms of this Advertiser Agreement (the “Agreement”) along with our Terms of Service and Privacy Notice. These documents govern your access to and use of our advertising services.
1. Scope of Agreement
This Agreement applies to all advertising services provided by Empire Yachting to businesses or individuals listing goods or services on our Website. You must accept and comply with all terms and conditions herein to participate.
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding agreements to advertise on our platform. Use of our services is prohibited if your account has been suspended or terminated.
3. Advertiser Responsibilities
As an advertiser, you agree that you will not:
- Post listings in inappropriate categories or misrepresent your offerings
- Violate any applicable law or third-party rights
- Engage in deceptive practices including price manipulation or “bait and switch”
- Circumvent billing structures or avoid fees
- Submit false or misleading contact or business information
- Promote or link to competing services without writen consent
- Upload or distribute malicious code, spam, or pyramid schemes
- Harvest user data without explicit consent You represent and warrant full compliance with all applicable Sanctions Laws and Export Control Laws, including those issued by the EU, UK, U.S., and any applicable jurisdiction. Empire Yachting reserves the right to remove any content or account found in violation.
4. Service Use and Limitations
Empire Yachting facilitates connections between third-party vendors ("Advertisers") and interested users. We do not guarantee transaction completion, nor do we verify the accuracy or quality of goods or services listed. All negotiations and contractual terms are strictly between the Advertiser and the interested party.
Advertisers are solely responsible for:
- Honouring all advertised terms and conditions
- Ensuring listings are accurate, legal, and clear
- Managing inquiries and direct communication
- Delivering goods or services as promised We reserve the right to conduct random quality checks and deny access to the platiorm if an Advertiser fails to meet acceptable standards.
5. Fees, Payments & Refunds
Advertisers agree to pay all listing and service fees in accordance with the selected advertising package. Fees are non-refundable except as expressly stated otherwise. Empire Yachting may revise pricing at any time upon notice. Failure to make timely payments may result in suspension or referral to collections.
All fees are quoted in Euros (EUR) or another applicable currency as agreed in writing.
6. Content Rights and License
By submiting content, including in the URL listing field link in listing, you grant Empire Yachting a non-exclusive, perpetual, worldwide, royalty-free license to use, copy, display, distribute, and sublicense your content for promotional and operational purposes.
7. Liability and Disclaimers
Empire Yachting is not responsible for: • The acts, omissions, or conduct of other users or Advertisers • The completion or success of any transaction • The accuracy or legality of any listing or material posted To the extent permited by law, we disclaim all warranties and will not be liable for indirect or consequential damages. Our maximum liability shall not exceed the total amount paid by you for advertising services.
8. Release
You release Empire Yachting, its officers, directors, agents, and employees from any claims, demands, or damages arising out of disputes with other users or third parties.
9. Access Restrictions
You agree not to:
- Use bots or scrapers to collect data from the Website
- Interfere with the Website’s performance or infrastructure
- Copy or reuse any proprietary content or materials without express authorization
10. Privacy
Use of the Website is governed by our Privacy Noticie. We do not sell your personal data and we take appropriate steps to secure all user information.
11. Indemnification
You agree to indemnify and hold harmless Empire Yachting from any loss, liability, or claim arising from your breach of this Agreement or misuse of our services.
12. Legal Jurisdiction
This Agreement shall be governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts in Palma de Mallorca, Spain.

By continuing to advertise with Empire Yachting, you acknowledge that you have read, understood, and agree to be bound by this Advertiser Agreement.
